Types of Information We Collect
In order to better provide you with a pleasant shopping experience, we collect two types of information about our users: Personally Identifiable Information (“PII”) and Aggregate Information.
Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. When you engage in certain activities on these Platforms, such as registering for an account, purchasing a product or service, or sending us feedback or messages, we may ask you to provide certain information about yourself.
Examples of PII may include your first and last name, email address, mailing address (including zip code), telephone number, and other identifying information. When ordering products or services on the Platforms, you may be asked to provide a credit card number.
Aggregate Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on our Platforms and what other Platforms may have directed you to us. This information, which is collected in a variety of different ways, is compiled and analyzed on both a personal and an aggregated basis. This information may include the Web Platforms’ Uniform Resource Locator (“URL”) that points to the Platforms you just came from, which URL you go to after visiting our Platforms, what browser you are using, and your Internet Protocol (“IP”) address.
How We Collect and Use Information
We do not collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain PII to us when you elect to use certain products or services available on the Platforms. These may include: (a) registering for an account on our Platforms; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email or in app messages; (e) submitting a form or transmitting other information by telephone or letter; or (e) submitting your credit card or other payment information when ordering and purchasing products and services on our Platforms. When processing certain information, such as payment information with affiliated banking institutions or payment processors, we encrypt the transaction, using Secure Socket Layer (SSL) encryption technology, in order to prevent your PII from being stolen or intercepted. Additionally, your credit card information is never stored on our servers and stored on a restricted-access database that is away from our main Platforms and only accessible by authorized users.
We will primarily use your PII to provide product or service offerings to you. We will also use certain forms of PII to enhance the operation of our Platforms, improve our internal marketing and promotional efforts, statistically analyze Platforms use, improve our product and service offerings, and customize our Platforms’ content, layout, and services. We may use PII to deliver information to you and to contact you regarding administrative notices. Finally, we may use your PII to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Platforms Terms of Use, and this Privacy Policy.
We may also collect Aggregate Information. For example, we may use your IP address to diagnose problems with our servers, software, to administer our Platforms and to gather demographic information.
Cookies
Depending on how you use our Platforms, we may store cookies on your computer in order to collect certain aggregate data about our users and to customize certain aspects of your specific user experience. A cookie is a small data text file which is stored on your computer that uniquely identifies your browser. Cookies may also include more personalized information, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server, and your first name to welcome you back to our Platforms. We may use cookies to perform tasks such as: monitoring aggregate Platforms usage metrics, storing and remembering your passwords (if you allow us to do so), storing account and advertising preferences that you have set, and personalizing the Services we make available to you. However, we do not use cookies to track your browsing behaviors.
Most browsers are initially set up to accept cookies, but you can reset your browser to refuse all cookies or to indicate when a cookie is being sent. However, some aspects of the Platforms may not function properly if you elect to disable cookies.
Release of Information
We will not sell, trade, or rent your PII to others. We do provide some of our product and service offerings through contractual arrangements made with affiliates, service providers, partners and other third parties (“Service Partners”). We and our Service Partners may need to use some PII in order to perform tasks between our respective Platforms, or to deliver products or services to you. For example, we must release your credit card information to the card-issuing bank to confirm payment for products and services purchased on this Platforms; release your address information to the delivery service to deliver products that you ordered; and provide order information to third parties that help us provide customer service.
We will encourage our Service Partners to adopt and promote strong privacy policies. However, the use of your PII by our Service Partners is governed the respective privacy policies of those providers, and is not subject to our control. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other Platforms accessible through these Platforms, including our Advertising and Service Partners, have their own privacy policies and data collection, use and disclosure practices. Please consult each Platforms’ privacy policy. We are not responsible for the policies or practices of third parties.
Occasionally we may be required by law enforcement or judicial authorities to provide PII to the appropriate governmental authorities. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.
We may also provide Aggregate Information about our customers’ sales, traffic patterns, and related Platforms information to third party advertisers, but these statistics do not include any Personally Identifiable Information.
Updating and Correcting Information
We believe you should have the ability to access and edit the PII that you have provided to us. You may change any of your PII in your account online at any time by linking to your account in accordance with instructions posted elsewhere on this Platforms.
We encourage you to promptly update your PII if it changes. You may ask to have the information on your account deleted or removed; however, some information, such as past transactions, logs of technical support calls, or other information may not be deleted. In addition, it may be impossible to completely delete your information without some residual information because of backups.
User Choices on Collection and Use of Information
We may, from time to time, send you an email regarding new products and services that we feel may interest you. If you do not want to receive solicitations from us, you can “opt-out” by accessing your account online editing your account information to no longer receive such offers and mailings. We will not give or sell your email to any 3rd party for solicitation or information purposes.
You also have choices with respect to cookies, as described above. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of our Platforms may not work properly in your case.
Security of Your PII
On our Platforms you can be assured that your PII is secure, consistent with current industry standards. We strive to take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of your PII. For example:
We work hard to ensure that the data we collect is reliable, accurate, complete and current. We encrypt all PII, in order to prevent unauthorized parties from viewing such information when it is transmitted to us. We also only keep collected information only for as long as reasonably necessary and use it only for the purposes for which it was collected or to comply with any applicable legal or ethical reporting or document retention requirements.
In order to most effectively serve you, credit card transactions and order fulfillment are handled by established third party banking institutions and processing agents (such as Stripe or PayPal). They receive the information needed to verify and authorize your credit card or other payment information and to process and ship your order.
Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your PII, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this Platforms cannot be guaranteed.
Miscellaneous
You must be at least 18 years old to have our permission to use this Platforms. Our policy is that we do not knowingly collect, use or disclose PII about minor visitors.
You should also be aware that when Personally Identifiable Information is voluntarily disclosed (i.e. your name, email address, etc.) in public areas on this Platforms, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages (including unwanted spam messages) from third parties. TERMS AND CONDITIONS OF USE
Welcome to our web platform. This Platform is maintained as a service to our customers. By using this Platform, you agree to comply with and be bound by the following terms and conditions of use. Please review these terms and conditions carefully. If you do not agree to these terms and conditions, you should not use this Platform.
Agreement. This Term of Use agreement (“the “Agreement”) specifies the Terms and Conditions for access to and use of journeyingwithjessica.com and Journeying with Jessica app (the “Platforms”) and describe the terms and conditions applicable to your access of and use of the Platforms. This Agreement may be modified at any time by Holistic Freedom, LLC upon posting of the modified Agreement. Any such modifications shall be effective immediately. You can view the most recent version of these terms at any time at journeyingwithjessica.com. Each use by you shall constitute and be deemed your unconditional acceptance of this Agreement.
Privacy. Your visit to our Platforms is also governed by our Privacy Policy. Please review our Privacy Policy above.
Ownership. All content included on these Platforms is and shall continue to be the property of Holistic Freedom, LLC or its content suppliers and is protected under applicable copyright, patent, trademark, and other proprietary rights. Any copying, redistribution, use or publication by you of any such content or any part of the Platforms is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of these Platforms.
Intended Audience. These Platforms are intended for adults only. These Platforms are not intended for any children under the age of 18.
Trademarks. Holistic FreedomTM and others are either trademarks or registered trademarks of Holistic Freedom, LLC. Other product and company names mentioned on this Platforms may be trademarks of their respective owners.
Platforms Use. Holistic Freedom, LLC grants you a limited, revocable, nonexclusive license to use this Platforms solely for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use. You agree not to copy materials on the Platforms, reverse engineer or break into the Platforms, or use materials, products or services in violation of any law. The use of this Platforms is at the discretion of Holistic Freedom, LLC and Holistic Freedom, LLC may terminate your use of these Platforms at any time.
Compliance with Laws. You agree to comply with all applicable laws regarding your use of the Platforms. You further agreed that information provided by you is truthful and accurate to the best of your knowledge.
Indemnification. You agree to indemnify, defend and hold Holistic Freedom, LLC and our partners, employees, and affiliates, harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of the Platforms.
Disclaimer. THE INFORMATION ON THESE PLATFORMS ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS. YOU AGREE THAT USE OF THESE PLATFORMS IS AT YOUR SOLE RISK. HOLISTIC FREEDOM, LLC DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE EXTENT YOUR JURISDICTION DOES NOT ALLOW LIMITATIONS ON WARRANTIES, THIS LIMITATION MAY NOT APPLY TO YOU. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE PLATFORMS SHALL BE TO DISCONTINUE USING THE PLATFORMS.
Limitation of Liability. UNDER NO CIRCUMSTANCES WILL HOLISTIC FREEDOM, LLC BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE PLATFORMS, YOUR PLATFORMS USE, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE PLATFORMS AND/OR CONTENT IS TO CEASE ALL OF YOUR PLATFORMS USE.
You may have additional rights under certain laws (including consumer laws) which do not allow the exclusion of implied warranties, or the exclusion or limitation of certain damages. If these laws apply to you, the exclusions or limitations in this Agreement that directly conflict with such laws may not apply to you.
Medical Disclaimer. Holistic Freedom, LLC does not provide medical advice. The content of Holistic Freedom, LLC Platforms, text, graphics images and information, and other material on the Platforms are for general purposes only. Unless otherwise stated, product statements have not been evaluated by the Food and Drug Administration (FDA). Holistic Freedom, LLC products and product information is not intended to diagnose, treat, cure or prevent any disease. Holistic Freedom, LLC does not recommend or endorse any specific tests, products, procedures, opinions or other information that may be mentioned on these Platforms. Any reliance on information provided on Holistic Freedom, LLC’s Platforms is solely at your own risk.
Use of Information. Holistic Freedom, LLC reserves the right, and you authorize us, to use and assign all information regarding Platforms uses by you and all information provided by you in any manner consistent with our Privacy Policy.
Copyrights and Copyright Agent. If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to our Copyright Agent:
(a) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
(b) A description of the copyrighted work that you claim has been infringed;
(c) A description of where the material that you claim is infringing is located on the Platforms;
(d) Your address, telephone number, and e-mail address;
(e) A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
(f) A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Applicable Law. You agree that the laws of the state of Washington, without regard to conflicts of laws provisions will govern these Terms and Condition of Use and any dispute that may arise between you and Holistic Freedom, LLC or its affiliates.
Severability. If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
Waiver. The failure of Holistic Freedom, LLC to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by Holistic Freedom, LLC must be in writing and signed by an authorized representative of journeyingiwithjessica.com.
Termination. Holistic Freedom, LLC may terminate this Agreement at any time, with or without notice, for any reason.
Relationship of the Parties. Nothing contained in this Agreement or your use of the Platforms shall be construed to constitute either party as a partner, joint venture, employee or agent of the other party, nor shall either party hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.
Entire Agreement. This Terms of Use constitutes the entire agreement between you and journeyingiwithjessica.com and governs the terms and conditions of your use of the Platforms, and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and journeyingiwithjessica.com with respect to this Platforms. Notwithstanding the foregoing, you may also be subject to additional terms and conditions, posted policies (including but not limited to the Privacy Policy), guidelines, or rules that may apply when you use the Platforms. Holistic Freedom, LLC may revise this Terms of Use at any time by updating this Agreement and posting it on the Platforms. Accordingly, you should visit the Platforms and review the Terms of Use periodically to determine if any changes have been made. Your continued use of this Platforms after any changes have been made to the Terms of Use signifies and confirms your acceptance of any such changes or amendments to the Terms of Use.
